These Terms of Service ("Terms") govern your use of the DriverCar marketplace and website (the "Platform"). By creating an account, requesting or listing a vehicle, or otherwise using the Platform, you agree to these Terms. If you don't agree, don't use the Platform.

1. What DriverCar is

DriverCar operates a marketplace that connects drivers who want a rideshare- and delivery-ready vehicle with providers (vehicle owners and fleets) who list vehicles for weekly rental. DriverCar provides the technology and payment processing; it does not own the vehicles. The rental is a direct agreement between the driver and the provider, governed by the rental agreement you electronically sign at booking. Where the rental agreement and these Terms conflict on rental-specific matters, the rental agreement controls.

2. Eligibility & accounts

You must be legally able to enter a contract to use the Platform. To be approved as a driver and book a vehicle, you must be at least 21 and hold a valid driver's license. You're responsible for the accuracy of your information and for activity under your account. Keep your credentials secure and notify us of any unauthorized use.

3. Driver verification

Before booking, drivers must be at least 21 and complete verification, which may include identity verification, driver's-license and insurance documents, and proof of an active rideshare or delivery platform account. Approval is at DriverCar's and the provider's discretion and can be revoked if information is inaccurate or circumstances change. Eligibility shown on a listing (e.g. UberX, Comfort, XL, Lyft, delivery) is verified per platform, tier, and city — items marked "provider-claimed" or "manual review" are not independently confirmed.

4. Booking, the rental agreement & pickup

Booking follows these steps: you request a vehicle; the provider approves the request; you pay the first week and authorize a refundable deposit; you e-sign the rental agreement; and you complete a documented pickup (condition photos). A booking is only confirmed once payment and signing are both complete. The e-signed agreement is an immutable record of the terms you accepted.

5. Payments, deposits & fees

  • Weekly charge. DriverCar bills the weekly rate (rental + insurance/admin) automatically to your saved payment method each week until the rental ends.
  • Refundable deposit. A deposit is authorized as a hold (not an upfront charge) and released after return, less any documented charges (e.g. damage up to the deductible, tolls, citations, cleaning).
  • Fuel/charging. Paid by the driver and not billed by DriverCar.
  • Platform fee. DriverCar retains a platform fee from the provider's portion of each payment; the price you see is the all-in amount you pay.

Card payments are processed by Stripe; DriverCar does not store full card numbers. You authorize recurring (off-session) charges for the weekly rate and any documented amounts owed.

6. Renewals & missed payments

The rental renews weekly until you return the vehicle. If a weekly charge fails, the rental moves to a past-due state and you'll be asked to update your payment method and retry. Continued non-payment may result in a return request and recovery of the vehicle, and may incur additional charges as described in the rental agreement.

7. Returns & vehicle condition

You must return the vehicle in the condition documented at pickup, normal wear excepted, with the same fuel/charge level. A documented return report determines deposit release. Charges for damage, cleaning, tolls, or citations may be applied against the deposit or your payment method.

8. Driver responsibilities & prohibited uses

You are responsible for operating the vehicle lawfully and for all tolls, tickets, and citations incurred during your rental. You must follow the mileage policy and allowed uses on the listing. You may not: drive under the influence; sublease or let unauthorized drivers operate the vehicle; use the vehicle for illegal activity; remove or tamper with required equipment; or exceed the platforms/tiers the vehicle is approved for.

9. Incidents, damage & insurance

Report any accident, theft, or damage immediately in the app. You are responsible for damage up to the vehicle's stated deductible. Insurance coverage depends on the rental agreement, your app status at the time of the incident, and the facts of the claim — see the Insurance & Coverage page. DriverCar is not an insurer and does not guarantee coverage.

10. Providers

Providers must onboard, pass verification, and have each vehicle's proof of insurance verified before it is listed. Providers are responsible for the accuracy of their listings, the legality and roadworthiness of their vehicles, and compliance with applicable law. DriverCar may remove listings or suspend providers that don't meet these requirements.

11. Disclaimers & limitation of liability

The Platform is provided "as is" without warranties of any kind. DriverCar does not own, operate, or warrant the vehicles and is not responsible for the acts of drivers or providers. To the maximum extent permitted by law, DriverCar is not liable for indirect, incidental, or consequential damages, and our aggregate liability is limited to the amounts you paid to DriverCar in the prior three months. Some jurisdictions don't allow certain limitations, so some may not apply to you.

12. Suspension & termination

We may suspend or terminate access for violations of these Terms, non-payment, safety concerns, or fraud. You may stop using the Platform at any time; obligations incurred before termination (including amounts owed) survive.

13. Changes & governing law

We may update these Terms; material changes will be posted with a new "last updated" date. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules.
